Pure as Lab offers this website and the "Compare Two Lists" Add-on, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein. By visiting our site and/or using our Add-on, you engage in our "Service" and agree to be bound by the following Terms of Use.

2. Service Description

The "Compare Two Lists" Add-on provides the following functionality:

  • Comparing two columns of data within a Google Sheets document
  • Identifying values that appear only in the first list, only in the second list, or in both lists
  • Generating a results sheet with the comparison outputs
  • Customizing comparison options (case sensitivity, whitespace handling, header row exclusion)

3. Eligibility and User Accounts

3.1 Eligibility

You must be at least 16 years old to use the Add-on in the European Union, and at least 13 years old in the United States or other countries. The Add-on is not intended for use by children.

3.2 Google Account

You must have a valid Google account to use the Add-on. Your use of Google services is subject to Google's own Terms of Service and Privacy Policy.

4. Permissions and Data Usage

4.1 Required Permissions

The Add-on requires the following permissions:

  • https://www.googleapis.com/auth/spreadsheets.currentonly: Allows the Add-on to view and modify only the specific Google Spreadsheet that you are using with the Add-on
  • https://www.googleapis.com/auth/script.locale: Allows the Add-on to determine your locale settings
  • https://www.googleapis.com/auth/drive.file: Allows the Add-on to view and manage files that you have explicitly opened or created with the Add-on

4.2 Data Processing and Storage

As described in our Privacy Policy:

  • The Add-on processes only data you explicitly select for comparison
  • Comparisons are performed within Google's infrastructure
  • We do not store your spreadsheet data on our servers
  • Minimal user preferences are stored using Google's PropertiesService
  • All data processing complies with our Privacy Policy

5. User Responsibilities and Restrictions

5.1 Acceptable Use

You agree to use the Add-on only for lawful purposes and in accordance with these Terms. You are responsible for all activities conducted through your account.

5.2 Prohibited Activities

You shall not:

  • Use the Add-on to process or store sensitive personal data (such as health information, financial data, or government identification numbers) unless you have implemented appropriate safeguards
  • Use the Add-on in any way that could damage, disable, overburden, or impair the Add-on or Google's services
  • Attempt to gain unauthorized access to the Add-on or related systems
  • Use automated scripts to access the Add-on outside of the API and functionality provided
  • Reverse engineer, decompile, or attempt to extract the source code of the Add-on
  • Remove any copyright, trademark, or other proprietary notices
  • Use the Add-on in violation of any applicable law or regulation

6. Intellectual Property Rights

The Add-on, including all intellectual property rights therein, is and remains our property. These Terms do not grant you any rights to use our trademarks, logos, domain names, or other brand features.

6.2 Feedback

If you provide feedback, ideas, or suggestions regarding the Add-on ("Feedback"), we are free to use such Feedback without compensation or attribution to you.

7. Privacy and Data Protection

7.1 Privacy Policy

Your use of the Add-on is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy for information on how we collect, use, and disclose information from our users.

7.2 Data Controller and Processor Roles

For purposes of the GDPR and other applicable data protection laws:

  • You (the user or your organization) are considered the "Data Controller" for any personal data contained within your Google Sheets that the Add-on processes
  • We act as a "Data Processor" when handling any personal data as part of providing the Add-on functionality
  • Google acts as a sub-processor in providing the infrastructure on which the Add-on operates

7.3 Data Transfer

All data processing occurs within Google's infrastructure. Google's data centers are located globally, and your data may be processed on servers located outside of your country of residence. Google maintains compliance with data transfer mechanisms such as Standard Contractual Clauses as required by the GDPR for EU users.

7.4 California Consumer Privacy Act Compliance

For California residents, we provide specific rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) as detailed in our Privacy Policy. Since we do not sell or share your personal information with third parties for their commercial purposes, many CCPA provisions may not apply to our limited processing activities.

7.5 Data Retention

We retain:

  • Your comparison preferences only during your active session
  • No persistent storage of your spreadsheet data
  • Any error logs that may contain technical information (not your spreadsheet data) for a maximum of 30 days

8. Disclaimers and Limitations of Liability

8.1 Disclaimer

Your use of the Add-on is at your sole risk. The Add-on is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

We do not guarantee, represent or warrant that your use of our Add-on will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the Add-on will be accurate or reliable.

You agree that from time to time we may remove the Add-on for indefinite periods of time or cancel the service at any time, without notice to you.

8.2 Limitation of Liability

In no event shall Compare Two Lists, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, special, consequential or punitive damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Add-on or any products procured using the Add-on, or for any other claim related in any way to your use of the Add-on or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Add-on or any content posted, transmitted, or otherwise made available via the Add-on, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8.3 Indemnification

You agree to indemnify, defend and hold harmless Compare Two Lists and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

8.4 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Add-on, or your violation of these Terms.

10. Termination

10.1 Termination by You

You may terminate these Terms at any time by uninstalling the Add-on from your Google Workspace account and revoking its permissions through your Google account settings.

10.2 Termination by Us

We reserve the right to terminate or suspend your access to the Add-on or any part thereof at any time, without prior notice, for any reason at our sole discretion. This includes, but is not limited to, if we suspect that you have failed to comply with any term or provision of these Terms of Use.

We may also restrict, suspend, or terminate your access to the Add-on if we believe that your actions may cause legal liability for you, our users, or us, or if we believe your use of the Add-on violates any applicable laws or regulations.

10.3 Effect of Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

Upon termination:

  • Your right to use the Add-on will immediately cease
  • Any data associated with your usage that we may have stored will be handled according to our Privacy Policy
  • All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Use, we may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination, if applicable.

11. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on the Google Workspace Marketplace listing. By continuing to access or use the Add-on after revisions become effective, you agree to be bound by the revised Terms.

12. General Legal Terms

12.1 Governing Law

These Terms shall be governed by the laws of the People's Republic of China, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.2 Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall first be resolved through friendly consultation. If the dispute cannot be resolved through consultation, either party may submit the dispute to the People's Court of Hangzhou, Zhejiang Province, China, which shall have exclusive jurisdiction over such disputes.

For users outside of China, if mandatory local consumer protection laws in your country of residence contain provisions that override this jurisdiction clause for certain types of disputes, those provisions shall apply.

12.3 Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

12.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by our authorized representative.

12.5 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null. We may freely assign or transfer these Terms without restriction.

12.6 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Add-on and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
